I direct that as soon as may be thought advisable after my decease, all or so much of my property as may be found necessary shall be sold and the proceeds applied to the payment in full of all my full debts. I direct that my property situated in Durham Street if it shall not be necessary that it be sold for the purpose just mentioned, shall be invested in such persons as Trustees as my Executors shall appoint for the benefit of my Son John to pay to him the Rents of said property and my said Son John shall not dispose of the property otherwise than by Will. I further direct that such of my property as may remain unsold for the purpose of paying my debts shall either be divided equally among the children of my two daughters Jane and Catherine, or shall be sold and the proceeds equally so divided. In the event of my Son John not being surviving at my decease, or failing to dispose by Will of the property hereby bequeathed to himsaid property shall be divided among my said grandchildren in the same way. I hereby appoint John M Saunders Esq and Rev. William Purves Executors of this my last Will and Testament. Made this twenty seventh day of September 1865.

Will of Thomas IVEY, decd, proved in common form before the Worshipful William Short, Clerk. And Admion of all and singular the goods and effects of the deceased and any way concerning the said Will was granted to Alice Ivey, the widow of the said deceased and the Executrix named in the said Will. No inventory.
THIS IS THE LAST WILL AND TESTAMENT of me Thomas IVEY of the Parish of Crowan, Yeoman. I give and bequeath unto my son Thomas IVEY all my right title and interest in my holding in Binner together with all my dead and quick stock and husbandry implements which shall be thereon at the time of my death except corn and household furniture which I give my residuary Legatee hereafter named and I will that John Trevenen shall and do hold that part of Binner now in his possession until Michaelmas one thousand eight hundred and ten, he paying to my said son Thomas Ivey the rent thereof sixty guineas per annum, paying quarterly, but the said John Trevenen shall and do within three months after my death give notice in writing to my said son Thomas that he will yield and deliver up possession of his holding at Michaelmas one thousand eight hundred and ten – and I also give my said son fifty pounds payable in six months.
I give and bequeath to my son John IVEY fifty pounds to be paid him in six months after my death. I give and bequeath to my son Henry IVEY one hundred pounds to be paid him in six months after my death. I give and bequeath to my son Richard IVEY one hundred pounds to be paid him in six months after my death. I acquit my said sons Thomas, John, Henry and Richard and also my son Wearne IVEY of all sum and sums of money whatsoever which they shall severally owe or be in any manner indebted to me at the time of my death.
I give unto my daughter Alice the wife of Henry Williams the younger twelve pounds per annum payable quarterly by my Executrix and I will that my Executrix shall pay it only to my daughter and not to any other person, and my daughter’s receipt shall be the only discharge for the same, her ……. Notwithstanding, and which annuity shall continue to be paid during the joint lives of my said daughter Alice and her said husband. My daughter Alice surviving her said husband I recommend to my Executrix to pay her my said daughter three hundred pounds.
I give unto my daughter Grace the wife of Henry Pascoe one hundred pounds, also seven pounds to be paid her in six months after my death. I give unto my daughter Mary the wife of Charles Tyacke one hundred pounds to be paid her in six months after my death. I give unto my daughter Sarah the wife of Thomas Gundry one hundred pounds to be paid her in six months after my death. I give unto my daughter Johanna the wife of John Trevenen one hundred pounds to be paid her in six months after my death.
All the rest residue and remainder of my goods chattels rights credits and effects whatsoever and whensoever and of what nature kind or sort soever I give and bequeath unto my dear wife Alice IVEY and I nominate and appoint her my said wife sole Executrix of this my last Will and Testament. In Witness whereof I have to this my last Will and Testament set my hand and seal this twenty second day of March one thousand and eight hundred and nine.
